1. Acceptance of Terms
By accessing or using EmoteShare ("the Platform"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this site.
2. Eligibility
To use EmoteShare, you must:
- Be at least 18 years of age
- Have the legal capacity to enter into these Terms
- Not be prohibited from using the Platform under applicable law
- Create only one account per person
3. User Accounts
Account Creation
- You must provide accurate and complete registration information
- You are responsible for maintaining the security of your account
- You must immediately notify us of any unauthorized access
Username Rules
- 3-40 characters, letters, numbers, underscores, and hyphens only
- Case-insensitive (JohnDoe and johndoe are the same)
- Cannot impersonate other users, brands, or public figures
- Cannot contain offensive or inappropriate content
4. Acceptable Use
You agree NOT to:
- Post content that is illegal, harmful, threatening, abusive, or harassing
- Engage in harassment, bullying, or intimidation of other users
- Post sexually explicit or violent content
- Spread misinformation or fake news
- Spam or send unsolicited messages
- Impersonate others or misrepresent your identity
- Attempt to gain unauthorized access to other accounts
- Use automated systems (bots) without authorization
- Interfere with the Platform's operation or security
- Violate any applicable laws or regulations
5. Content Ownership
Your Content
You retain ownership of content you upload to EmoteShare. By uploading content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content on the Platform.
Platform Content
EmoteShare and its original content, features, and functionality are owned by us and are protected by copyright, trademark, and other intellectual property laws.
News Content
News articles displayed on the Platform are sourced from third-party providers. We do not claim ownership of this content. All copyrights belong to the original publishers.
6. Emoji Reactions
EmoteShare uses emoji reactions as the primary form of interaction. You understand that:
- Reactions are public by default
- You can only react once per piece of content
- Reactions may be used to personalize content recommendations
- Aggregate reaction data may be displayed publicly
7. Content Moderation
We reserve the right to:
- Remove content that violates these Terms
- Suspend or terminate accounts for violations
- Report illegal content to law enforcement
- Use automated systems to detect violations
Users can report content or accounts they believe violate these Terms. We review reports and take appropriate action.
8. Account Suspension and Termination
We may suspend or terminate your account if you:
- Violate these Terms
- Engage in illegal activity
- Abuse the Platform or other users
- Create multiple accounts
You may delete your account at any time through Settings. See our Privacy Policy for data retention details.
9. API and Developer Access
If you use our API:
- You must comply with our API rate limits
- You may not use the API for spam or abuse
- API keys are personal and must not be shared
- We reserve the right to revoke API access for violations
10. Disclaimer of Warranties
The Platform is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:
- Implied warranties of merchantability
- Fitness for a particular purpose
- Non-infringement
- Accuracy, completeness, or reliability of content
We do not warrant that the Platform will be uninterrupted, secure, or error-free.
11. Limitation of Liability
To the maximum extent permitted by law, EmoteShare and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses, resulting from your use of the Platform.
12. Indemnification
You agree to indemnify and hold EmoteShare harmless from any claims, damages, losses, or expenses arising from your use of the Platform, your violation of these Terms, or your violation of any rights of a third party.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or platform notification. Continued use of the Platform after changes constitutes acceptance of the new Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which EmoteShare operates, without regard to its conflict of law provisions.
